Shipley Do-Nuts received approval of its specific use permit for a drive-in window, but because of conditions set forth by city council will only be able to operate the window during certain hours.
Shipley’s was seeking approval from Bellaire City Council for a specific use permit that would allow them to use a drive-in window that is already installed at 5225 Bellaire. Shipley’s needed council’s approval in order to use the drive-in.
Council unanimously approved Shipley’s specific use permit with two conditions: the drive-in window can only operate from 7 a.m. to 7 p.m. for a six month trial period before coming back to council for consideration and they have to place a convex traffic mirror at the rear of the property.
Council was hoping to address resident’s noise concerns with the conditions that were set.
Two residents came before council during its Oct. 11 meeting with noise concerns because of the close proximity of their houses to the shopping center.
“I’m concerned with what was raised,” said Councilmember Andrew Friedberg, who wanted to protect the residents but also support commercial development.
Councilmember Mandy Nathan suggested limiting the hours on the drive-in for a period of time so council could see how it goes.
“I would be reluctant to approve it forever,” said Mayor Cindy Siegel, who had concerns about the space in the alley and the hours being difficult for residents.
Siegel said she would like to see Shipley’s occupying the space, but doesn’t know if the drive-in is the right fit.
Councilmember Will Hickman said he was in support of the specific use permit that was filed.
If Shipley’s agrees to the conditions for the drive-in, they will have to come back to council in six months.
