Marlowe Lot Declared Surplus Property

The lot at 3936 Marlowe has been declared surplus property by the West U. City Council and can now be put up for auction. The city bought the property from the owners for $400,000 after a three-year legal battle concerning the design of the home under construction. The unfinished home has since been torn down.
Councilman Michael Talianchich asked that if the city profits from the sale of the property that the profit be shared with the previous owners as a gesture of “good faith.”
“It was a very difficult situation they went through for three years,” said Talianchich.
The city attorney indicated that doing so is probably prohibited from a legal standpoint.
“I think we held it a respectful period of time,” said Mayor Bob Kelly. “It is time to get it off our rolls.”
